Jim Brown's Suit Against Madden Dismissed

Former football player Jim Brown's lawsuit against Madden has been dismissed by a judge. Brown was suing because he believed his likeness had been used on two separate characters in Madden games and felt that this could be viewed as an endorsement on this part. However, the judge said that , "The Madden NFL video games are expressive works, akin to an expressive painting that depicts celebrity athletes of past and present in a realistic sporting environment."

An EA spokeperson says We're pleased with the decision and believe it is consistent with other rulings, which affirm video games are expressive works protected by the First Amendment."
